Terms and Conditions for Ticket Sale

The visitor attraction known as Chinatown Heritage Centre, and situated at 46, 48 & 50 Pagoda Street, Singapore 059207 (“the Attraction”) is owned by Singapore Tourism Board. All persons visiting the Attraction are subject to the following Terms and Conditions and by acquiring one or more tickets to The Attraction (“Ticket” or “Tickets”) you confirm to Chinatown Heritage Centre Pte Ltd (CHCPL) that you accept these terms and conditions of use. Ticket holders are referred to in these Terms and Conditions as “Visitors”. These conditions also cover those who have Complimentary Tickets.

1. Tickets

1.1 One Ticket purchased entitles one-person entry to the Attraction on a single occasion. Once Visitors have left the Attraction, they will need to purchase an additional Ticket to re-enter the Attraction.

1.2 Save as otherwise permitted by the CHCPL, you must pay for admission prior to use or access to the Attraction. All persons entering the Attraction must hold a valid Ticket that must be retained at all times and submitted for inspection if required by any member of staff. Failure to produce a valid Ticket on request may result in removal from the Attraction.

1.3 No ticket may be resold without the prior written consent of CHCPL. CHCPL shall retain the sole discretion to refuse entry to any person or to remove any person from the Premises without refund or compensation to such person(s) affected, if it reasonably believes that any ticket held by such person has been resold without CHCPL’s prior consent.

1.4 Only tickets purchased from CHCPL authorised sources will be permitted to use and access to the Attraction. If you have any doubt in this regard, or for more queries, please contact CHCPL’s hotline at (65) 6224 3928, email us or approach the Attraction ticketing counter for assistance. In event of any ticket fraud, no entry or refund will be allowed.

1.5 Where Ticket prices vary according to age, the following provisions apply:

1.5.1. A person of more than 12 years is classed as an adult;

1.5.2. A person aged 7 to 12 years is classed as a child; and

1.5.3. Except for group tours, an adult-accompanied child under 7 years no admission fee will be charged. 1.5.4. The price of Tickets may vary from time to time and the prices advertised are not guaranteed.

1.6 Once acquired, whether by purchase or on a complimentary basis, Tickets are non-refundable, non-transferable and void if altered and Tickets that CHCPL reasonably suspects have been transferred or altered will not be honoured. If lost, Tickets will not be replaced.

1.7 From time to time, CHCPL may issue Tickets under special promotions (“Promotional Tickets”) but Promotional Tickets will be available subject to availability and subject to any terms and conditions affecting the particular promotion.

1.8 CHCPL shall retain the right to sell tickets to such third parties agents, who may, in turn, sell tickets to the Attraction to you. In addition to these terms & conditions, you also hereby agree to be bound by any terms and conditions as may be agreed between such third parties and CHCPL. A copy of such terms and conditions are available at all Ticket Counters and on the Attraction’s website at www.chinatownheritagecentre.com.sg. CHCPL shall not be liable to you or any other person, for any loss or damage which may arise out of or in connection with or as a consequence of the acts or omissions of any third party including, but not limited to, loss of profit, expense, cost, goodwill, reputation, distress, inconvenience, anxiety, damage to or loss of property or items belonging to you or any other person, or for any personal injury which you or any other person may suffer (save for such personal injuries which may be caused by CHCPL’s or its’ employees’ negligence).

2. Pre-Booked Tickets

2.1 Pre-booked Tickets should be collected from the main entrance of the Attraction.

2.2 Persons wishing to redeem pre-booked Tickets must be able to produce to the Attraction staff the following items:

2.2.1. The booking reference issued when Tickets were booked; and

2.2.2. The credit card used to pay for the Tickets and, if the credit card holder is not attending on the day, you will need a signed letter giving permission to collect the tickets with the named party bringing photo ID. This letter will be retained by Chinatown Heritage Centre, Singapore.

2.3 Pre-booked Tickets may not be used in conjunction with any voucher, promotion or special offer.

3. Children

3.1 Children 12 and under must be accompanied by an adult over the age of 18.

3.2 Some areas of the Attraction may not be suitable for children of certain ages and CHCPL reserves the right to refuse access to such areas to Visitors under any recommended age limit.

4. Health and Safety

4.1 A variety of special effects and narrow stairways (including sudden loud effects and strobe lighting) may be used in certain visitor areas of the Attraction. It is recommended that Visitors with high blood pressure, heart conditions or other pre-existing medical conditions ask the Attraction staff for further details and avoid areas of the Attraction at which such special effects and narrow stairways are used. From time to time the Attraction staff may draw Visitors’ attention to certain health and safety procedures to which Visitors must adhere.

5. Visitor’s Conduct

5.1 Visitors are required to observe the following prohibitions while at the Attraction:

5.1.1. No smoking;

5.1.2. No pets or animals except for guide dogs and hearing dogs;

5.1.3. No consumption of food or drink without the express permission of CHCPL;

5.1.4. No offensive weapons;

5.1.5. No flash photography

5.1.6. No video recordings.

5.1.7. No removal of artefacts and exhibits.

5.1.8. No access to any area of the Attraction other than areas designated for access by Visitors; 5.1.9. No unnecessary noise (whether from mobile phones or personal stereos or otherwise) or behaviour likely to annoy or offend other Visitors or intimidate the Attraction staff; 5.1.10. No use of illegal drugs or consumption of alcohol. 5.2 CHCPL reserves to right to refuse entry to or expel from the Attraction any Visitor who fails to observe the prohibitions at condition 5.1 or whom CHCPL considers likely to affect the safety or enjoyment of any other Visitor or member of staff.

6. Security

6.1 In the interests of safety, Visitors may be asked to submit to a health screening or search of their person or belongings and anyone refusing to submit or found to be in possession of materials believed by CHCPL to be dangerous or unsuitable will be denied entry or removed from the Attraction.

6.2 Visitors must keep their personal belongings with them at all times and CHCPL accepts no responsibility for loss, theft or damage to any personal belongings brought into the Attraction.

7. Photography

7.1 From time to time CHCPL or any party authorized by CHCPL may carry out photography and/or video recording and/or other monitoring in the Attraction, including of all visitors and/or ticket holders. You hereby grant CHCPL and such party authorised by CHCPL the rights, in perpetuity and throughout the world, to use such images for promotional, advertising, publicity or other purposes and in any format or media whatsoever. You further acknowledge that copyright in these materials shall vest in and belong to CHCPL or such party authorised by CHCPL (as the case may be) and hereby waive any moral or other rights which they may have in or to such materials.

8. CHCPL’s Obligations

8.1 Visitors are reminded that from time to time parts of the Attraction may be closed and certain exhibits may be removed for private functions, maintenance or for technical reasons. Tickets will not be refunded and no compensation will be paid in the event of such closures or removals.

8.2 CHCPL will use its reasonable endeavours to be open and operational during published opening hours but reserves the right to close the Attraction on any given day, whether for security or any other reason, without notice. In the event of such closure, any Tickets issued for use only on the day of closure will be exchanged or refunded by CHCPL at the price paid for them but no further compensation will be paid.

9. Limitation of liability

9.1 Other than liability for death or personal injury resulting from CHCPL’s negligence, neither CHCPL, its employees nor its agents shall be liable to you for any loss or damage suffered by you, directly or indirectly, howsoever arising, including, without limitation, any loss, damage, expense, cost, profit, goodwill, reputation, or any distress, inconvenience or anxiety, which may arise out of or in connection with your use or your access to any part of the Attraction.

10. Intellectual Property and Information

10.1 You agree and accept that all the information (such as documents, data, information, written words, images, software, music, audio files or other sounds, photographs, videos or other images) (hereinafter referred to as “the Information”) which you may have access to as part of, or through your use or access to the Attraction are owned by CHCPL or its licensors.

10.2 You acknowledge and agree that CHCPL or its licensors own all legal rights, title and interest in and to the Attraction, including any intellectual property rights which subsist in the Attraction (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Attraction may contain information which is designated confidential by CHCPL and that you shall not disclose such information without CHCPL’s prior written consent.

10.3 Nothing herein shall be construed as CHCPL granting, by implication, estoppel, or otherwise, any license or right to you to use any of the Information displayed on the Attraction’s website, without the written permission of CHCPL.

11. General Terms

11.1 These terms and conditions shall be governed by, and construed in accordance with, the laws of the Republic of Singapore.

11.2 Mediation and Arbitration – In the event of any dispute arising out of or in connection with the terms and conditions herein, or the breach, termination or invalidity thereof, you agree that such dispute shall first be submitted to the Singapore Mediation Centre (“SMC”) for mediation in accordance with the procedures set out by the SMC. In the event that such dispute cannot be resolved or settled through mediation as set out above, you agree that the dispute shall thereafter be referred to and finally resolved by arbitration in Singapore in accordance with such arbitration rules as may be agreed between you and CHCPL. The arbitration tribunal shall consist of a sole arbitrator to be appointed by the Chairman of the Singapore International Arbitration Centre (“SIAC”). The language of the arbitration shall be English.

11.3 Severance – If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

11.4 Non-assignment – You may not assign, or otherwise transfer any of your rights or obligations under these terms and conditions. CHCPL may assign or transfer any of its rights or obligations under these terms and conditions to such third parties as it deems fit by way of notice in writing to you.

11.5 Non-waiver of rights – Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.

11.6 No third party rights – No third party shall have any right under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of these terms and conditions.

11.7 Changes to these terms – CHCPL reserves the right to make any changes to the terms and conditions set out herein from time to time, and you agree to be bound by such updated or revised terms and conditions as and when they are updated or revised.
